Mechanisms safeguarding mammalian genome stability during cell division in the context of cancer

Anna is delighted to be appointed to the Mitotic Progression group headed by Professor john. The Johns lab studies mechanisms safeguarding mammalian genome stability during cell division in the context of cancer (Johns Lab is a private organisation).

Anna is appointed to work across
twenty (20) workshops – [two (2) workshops a month for ten (10 months)] teaching and
assisting post-graduate students. The John Lab HR panel tells Anna that she will be paid on
a per workshop basis ($825) and is not considered to be an employee. Each workshop has 15
students enrolled. When Anna receives the contract, she notices that the contract say’s ‘fixed
term’. She signs it and scans it back to the HR department.

Each workshop will focus on cutting-edge fixed and live cell imaging and biochemical analysis.
The expectation is that Anna will possess excellent lab skills, bookkeeping and communication skills because Anna  will be the sole lab technician. After each workshop, Rose must fill out a Lab Report on how the workshop went, mark the student’s assessment, and provide feedback.

Jillian, the administrator at Johns Lab, has told Rose that she needs a current comprehensive first aid certificate (costing $250) before the first workshop; however, Johns Lab will not pay for the first aid certificate.

Before the first workshop – Anna receives the workshop timetable via a shared drive; the
timetable sets out the dates, the time the workshops begin and end, and the laboratory Anna must use for the workshop.

Each workshop has an expected topic that must be covered, and the students are expected to complete each assessment and submit it through Johns Lab’s Moodle page. Anna must follow the instructions for each workshop.

Anna  is expected to wear black lab-safe shoes, a black skirt, a black top, and a lab coat that James Lab supplies. When the lab coat arrives, it has Anna’s name embroidered under ‘James Lab’. After each workshop, Anna submits the student attendance, her workshop timesheet, and her Lab report to the administrator, Jillian. HR pays Anna once Jillian has approved payment.

When Rose receives the payment for the first workshop, she notices the payment is a net figure, not a gross figure there is also a deduction of $165 as only 12 students attended the first workshop
Anna approaches Jillian for clarification – Jillian tells Anna that the tax has been removed and
payment was for 12 students [not 15 students].

After four workshops, Anna realised that the
three students had withdrawn from the course. Anna is confused because she thought she
was not an employee.

Advise Anna on whether she is a contractor of service OR a contractor for services. Make sure
you explain your answer. (25 marks)

The Second instalment

Last year Katie bought a car from Oliver for Ksh 350,000 to be paid in two instalments of Ksh 175,000. Katie did not pay the second instalment when it was due. She never disputed that she owed Oliver this money.

Oliver felt sorry for Katie, who lost her job not long after buying his car. He told her that if she paid him the half of what she owed him (Ksh 87,500) by the following Wednesday, he would let her off with the rest.Katie paid him the Ksh 87,500 on the following Tuesday. She also gave him a bottle of wine “in consideration of his kindness”.

On Friday Katie was notified that she had been successful in one of her job applications and would be starting work at a much better salary than her old job on the first of the following month.Oliver has heard about Katie’s new job and realizes that she is likely to be earning more than he is.

He now wishes to claim the rest of the money which she had originally agreed han he is. He now wishes to claim the rest of the money which she had originally agreed to pay for the car.

The whole of The law relating relating to offer and acceptance

The fact that offer and acceptance are not a requirement of a valid contract, but only a means of analysing the existence of agreement, means that the whole of the law relating relating to offer and acceptance should best be regarded as resting on a small number of general principles, which are exemplified by innumerable decisions of facts in individual cases.

T.A Downes (a)analyse the meaning of this statement and assess the extent to which professor T.A Downes is justified in making it.(7mks) (b) Identify the ‘small number of general principles’ upon which the law of offer and acceptance are based.Using decided cases to illustrate your answer, examine the practical application of those principles by the courts when using offer and acceptance to decide whether a contract exists(8mks)

The current court and Clarence Thomas’ concurring opinion in Box v Planned Parenthood of Indiana

Think about Buck v Bell, the court decision, eugenics movement and then think about the current court and Clarence Thomas’ concurring opinion in Box v Planned Parenthood of Indiana & Kentucky, et al (https://www.supremecourt.gov/opinions/18pdf/18-483 3d2g.pdf), right to life/pro-choice movement.

The Buck decision is arguably a decision not reflective of our country’s ethical movement. Write a 2-3 page position on whether abortion is a form of eugenics; what ethical model you use. What rationale did the Supreme Court use in determining the status of abortion.

The Shares as a store of wealth to be kept for a “rainy day”

Instead of ensuring the contents of her house, Miss Potgieter purchased shares in Tesla Inc every year as a form of self-insurance. She acquired the shares as a store of wealth to be kept for a “rainy day” and she hoped that her investment in Tesla Inc would act as a hedge against inflation.

After buying shares in this way for the past 5 years, Miss Potgieter’s eldest child presented her with wedding plans and asked her if she could help bear the cost of the wedding. Although not quite wishing to characterize the event as a “rainy day”, Miss Potgieter agreed to finance the wedding and sold all her shares in Tesla Inc to help cover the wedding expenses. She sells the shares for a whooping N$ 120 000.

The Reciever of Revenue has included the profits realized on the sale of the shares in Miss Potgieter’s Taxable Income for her 2020/2021 income tax assessment and Miss Potgieter has approached you to lodge and objection against the inclusion of the share’s profits in her gross income for the year in question.

The cost of the shares was N$ 40 000 and the proceeds on the sale were N$ 120 000 and the amount included in Miss Potgieters’ taxable income is the profit of N$ 80 000. With reference to all relevant legislation and case law, lodge an objection against the inclusion of the N$ 80 000 profit in the income for the 2020 year of assessment.
