12. refer to Hare’s Revised Psychopathy Checklist on page 100. A high combination of the factors listed are believed to reliably indicate a “psychopath.” These factors appear to vary with age, social class, cognitive abilities, drug and or alcohol abuse, and violent behavior.

Name at least two of the traits of a “psychopath” and explain why each trait applies to many “normal” people.   An example may be “pathological liar” a psychopath may lie so often, that they learn how to lie so well that people cannot tell they are lying. They can then lie to potential victims to manipulate the victim by telling the victim what they think the victim needs to hear to feel safe with the psychopath,  so the psychopath can lure the victim into a situation they would not have otherwise put themselves into. (i.e., getting into a car with a strangerfrom a bar).

Primary 5 students to go to various Islands in Hong Kong

The Peak School organized a package tour for Primary 5 students to go to various islands in Hong Kong, including a tourist resort at Lantau Island. The tour operator was Holiday Package Limited, a large and well-known package tour organizer providing accommodation,
sightseeing services and other facilities in Hong Kong. It operated by contacting other
organizations on different outlying islands.

Holiday Package Limited’s brochure stated that all
the cruise operators “are competent and experienced in providing such services”.

A party of Primary 5 children of the Peak School accompanied by Christina, the school teacher,
went on tour through Holiday Package Limited. One afternoon they went on an expedition
organized by Titanic Cruises on the sea near Tai O, on the western coast of Lantau Island. As
the boat approached a dangerous section of the water near a jetty, and the operator of the boat lost
control and the boat began to rock dangerously. All children were screaming and three children,
who was sitting next to Christina, were thrown into the water? Christina got a terrible shock
and collapsed on the boat.

Tim, a Fishman in Tai O, was fishing nearby and witnessed the accident. Although he was good
at swimming and familiar with the part of the water, he was too busy fishing to help the children
who were shouting for help in the water. Meanwhile, Chang who was standing on the jetty also
witnessed this gruesome accident and tried to climb down the jetty to save the children.
However, before he could do so he also fell into water.

Wilson on a passing boat rescued the
children and Chang and brought them back to the jetty. The children and Chang all suffered
serious physical injuries.

Wilson, who rented the boat from the Easy Boat Rental Company
(EBR), had to pay overtime charge of 10,000 dollars due to his rescue attempt. The owner of
the jetty, Kwong who had also witnessed the whole accident from his small office near the jetty
suffered from nervous shock.

The children, Christina, Chang and Kwong were all taken to hospital. They were discharged
from the hospital after a few days except Christina. Christina’s condition exacerbated because
she had been suffering from ‘psycho syndrome’ intermittently for one year in the past.

One night, three borstal teenagers escaping from a Correctional Institution of Lantau Island
went to the jetty. They broke the windows of Kwong’s office and stole 5,000 dollars in cash
from his office drawer. When the boys attempted to escape by boat, they destroyed one of the
EBR’s boats which were moored to the jetty.

Discuss whether the injured children, Christian, Chang, Willson, Kwong and the EBR can
establish the duty of care against the relevant parties by using case law.

Enduring Guardianship and Enduring Power of Attorney.

Two years ago, Olivia moved in with her son, Tommy, his wife, Sarah and their two children. Olivia speaks English well but it is her second language and at times she reverts to Italian. Tommy has Enduring Guardianship and Enduring Power of Attorney.

Sarah is in receipt of the carer’s payment and in the past, Tommy has been reluctant to accept aged-care community services for his mother so support is minimal. However, they do allow Olivia to go to respite care at ARC Gardens twice a month for a weekend.

Over time, Olivia has told workers that Sarah screams at her and Olivia keeps pointing to her head saying there is a lump. Olivia’s clothes are dirty and Olivia appears to be losing weight.

When you pick Olivia up to take her to respite care you notice that the house is very untidy with bills piled on the table. Sarah tells workers she is coping well, although Olivia had been admitted to hospital a couple of times for falls.

You have called a meeting to review Olivia’s situation. You are the care worker for 86 year old Olivia. Your trainer and classmate will play the role of your supervisor and a family member.

You will need to review ARC Gardens’ policies and procedures as well as the legal requirements for your state:

brief persuasive essay for:

QUESTION A.

‘[I]f one accepts the need for a counter-terrorist strategy, then one also needs to accept that pursuing such a strategy will inevitably entail the derogation of certain civil liberties. No country throughout history has implemented a counter-terrorist strategy that has not impacted in some way on civil liberties. Due legal process is a prominent part of our democratic way of life, but its importance is not absolute.

For example, if law enforcement agencies representing a democratically elected government reasonably conclude that they have grounds for detaining an individual whom they believe may be involved in, or have knowledge of, a terrorist plot that has the potential to kill Australian citizens and/or damage property and infrastructure, then given the urgency of preventing an attack from taking place it is hard to see why they should not have this discretionary power.’

(A. O’Neil, ‘The Evolving Nature of International Terrorism and Australia’s Response’ in D Chappell and P Wilson (eds), Issues in Australian Crime and Criminal Justice, LexisNexis 2005, 389).

I agree with the above statement, as common interest in national security overrides individual autonomy / I disagree with the above statement, as limiting individual liberties in the name of preventing a terrorist attack leaves the door open to abuse.
