Although mass strikes continued through the first half of the 20th century, the United States involvement
in two world wars introduced new roles and relationships among workers, employers and government.
Price controls, war boards, state intervention, federal troop occupation and in-fighting between workers
and their unions were all part of the backdrop of the workers’ protests, wildcat strikes and violence from
all sides. Within this time period a new work stoppage strategy emerged, and became widely used: the sit-down.
Why was the sit-down such an effective strategy for workers to use in the workplaces of the 1930s and
the 1940s?

A drug rehabilitation program

Bonds tested positive for cocaine and was fired by Selig, Inc. for violating its drug-free workplace policy.  Bonds then enrolled in a drug rehabilitation program and was able to end his drug abuse.  He was drug-free for over two years and reapplied to Selig to be rehired.  To support his application, he provided letters from his pastor about his active church participation and from an Alcoholics Anonymous counselor about his regular attendance at meetings and his recovery.  Selig refused to rehire Bonds because of its policy against rehiring employees who are terminated for workplace misconduct.  Bonds claims that “no rehire” policy violates the ADA.  Does it?  Explain your answer.

Reorganizing workforce due to slumping auto sales

DeLormer is sales manager for Fast Freddy’s Auto Sales, a local car dealer selling Kia, Hyundai, and Subaru cars.  Fred Fischer, the owner of Fast Freddy’s, decides to reorganize his workforce due to slumping auto sales.  Fischer tells DeLormer, who is sixty, that his job will be eliminated, and the position’s duties will be consolidated with those of the service manager position.  Fischer also tells DeLormer that the new position will be filled by Gains, the current service manager, who is forty-two.  DeLormer feels that he is being terminated because of his age.  Does DeLormer have a good case?  Explain your answer.

They are both in the protected age category. That doesn’t mean there isn’t a case. The key phrase is the person who must you are comparing must be subsisting younger. In the 3rd circuit says if you are comparing to people and there are 3 years apart then you can have a case.
