For purposes of this assignment, I am adding the following facts: a. Kramer as for time off to observe Festivus and his company denied this request. b. Kramer does not show up to work on December 23, the day he requested off, and he his fired by H&H Bagel’s for failing to show up to his shift. c. Kramer sues H&H Bagel’s for religious discrimination. 3. Discuss whether Festivus would be legally recognized as a religion by the Court in Kramer’s lawsuit. Consider arguments which would be made by both sides and what information the Court would rely on.
