Ramblings of a Professional
On your own time, in the privacy of your own home, and using your own equipment, you have begun writing a blog entitled “Ramblings of a Professional” in which you write about your experiences as a classroom teacher. You have not identified the city or the school at which you teach, and your blog is under your first name only.
A parent of one of your students has discovered your identity as the blogger and has taken offense at some of your writings, believing you are referring to her (the parent) and her child.
The parent has reported you and your blog to your principal who, in turn, begins an investigation. A week later, you are informed you are being placed on administrative leave with the intent to begin due process proceedings to terminate you.
After the school board formally votes to terminate your employment, you file suit in federal court claiming your termination violated your right to free expression under the First Amendment. What is the likely result? Why?
