The Texas Bill of Rights
Hi class, after reading the Texas Bill of Rights I wanted to write about double jeopardyUnited. In my opinion double jeopardy occurs when a person is put on trial more than one time for the same offence. Double jeopardy is bought into question in the case of Gamble v. the Untied States. Mr Gamble was arrested in Alabama for being in possession of a 9mm handgun.
The state of Alabama charged Mr Gamble with being in possession of a firearm because he was previously convicted of a crime of violence. Mr Gamble pleaded guilty to the state charges, however, the federal government indicted him for being in possession of a firearm and ammunition because of he was previously imprisoned for more than one year. Gamble claimed that he was being put on trial for the same offence which Alabama’s him to double jeopardy.
The Supreme Court upheld the dual sovereignty doctrine, concluding the double jeopardy clause protects individuals from exposed. being punished twice for the same offence, however, if an individual is tried by two sovereigns, those are two separate offences. This means they put him on trial and punished him twice for the same offence. I do not agree with the ruling in this case.
I believe this is an example of double jeopardy. Mr. Gamble broke the law by carrying a handgun that day, but in my opinion, the State of Alabamas trial is the only one that should have been allowed. In this particular case, it seems unjustified that the federal government was able to convict Mr. Gamble for the same offence a second time.
